The EU AI Act's New Transparency Rules Are Live — Is Your Chatbot Compliant?
The EU's AI Act transparency rules took effect August 2, requiring chatbots to disclose they're AI. Here's what it means for builders and clients.
On August 2, 2026, the European Union began enforcing Article 50 of the AI Act — a rule that sounds narrow but touches almost every AI-powered product built today. The short version: if a person is talking to a bot, they now have a legal right to be told it's a bot. If that applies to anything you've shipped for a client, this is worth five minutes of your attention.
Article 50 requires that interactive AI systems — chatbots, voice assistants, AI avatars, customer support agents — clearly disclose to users that they're interacting with an automated system rather than a human, and that disclosure has to happen at first contact, not buried in a terms-of-service page. Deepfakes and synthetic media need visible labels, and AI-generated or AI-edited content needs machine-readable markings so platforms can detect it automatically.
The disclosure duty for chatbots and deepfakes is active immediately. The machine-readable content marking has a grace period through December 2026 for tools that were already on the market before August 2, giving builders a short runway to retrofit older deployments.
The rule applies to any AI system made available to users in the EU, regardless of where the company building it is based. That means a chatbot built by a US or Egypt-based agency for a European client — or one built anywhere but serving EU visitors — falls under the same obligations as an EU-native product. Company size doesn't create an exemption either; a two-person shop shipping a support bot for a client is in scope just like a large platform.
This isn't a toothless guideline. Non-compliance can bring fines up to €15 million or 3% of a company's global annual turnover, whichever is higher. For an agency, the practical risk isn't necessarily the agency getting fined directly — it's a client finding out after launch that the chatbot you delivered doesn't meet a legal requirement in a market they sell into, which is a much worse conversation than a five-minute build step would have been.
